§1 Scope
These General Terms and Conditions (GTC) apply to all contracts for the purchase and use of digital products – in particular online courses, webinars, video trainings, and accompanying materials – offered via the website www.yvonne-elrikabi.de under the brand name “Yvonne El-Rikabi” and provided by the Makana Knowledge GmbH, Havelstraße 16, 64295 Darmstadt, Germany.

§2 Subject Matter of the Contract
The subject matter of this contract is paid or free access to digital products, in particular online courses. The content is provided exclusively in electronic form via the member portal.

§3 Conclusion of Contract
The contract is concluded through the order placed via the online order form and the subsequent confirmation by Makana Knowledge GmbH. By submitting the order, the customer makes a binding offer, which is accepted by the provision of the product or a written order confirmation.

§4 Prices & Payment Terms
All prices are final prices in euros (including statutory VAT, where applicable). Payment is processed via the payment service providers offered during the ordering process (e.g., Stripe, PayPal). Access to the digital product will only be granted after full payment has been received.

§5 Delivery & Access
Delivery is digital, provided via login or direct access to the course area. Access data is usually sent by email immediately after successful payment.

§6 Rights of Use
The provided content is protected by copyright. The customer receives a simple, non-transferable right of use exclusively for private purposes. Distribution, reproduction, public performance, or commercial use is not permitted.

§7 Disclaimer
The content of the courses and products is for informational and educational purposes only. It does not replace medical, therapeutic, or psychological advice. Use is at your own risk. Makana Knowledge GmbH accepts no liability for any health damages unless caused by gross negligence or intent.

§8 Data Protection
The collection and processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and the data protection declaration on the website.

§9 Right of withdrawal for consumers
Cancellation Policy & Right of Cancellation: You have the right to cancel this contract within fourteen days without giving any reason.The cancellation period is fourteen days from the date of conclusion of the contract.

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email).

Consequences of withdrawal:
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will use the same means of payment as you used for the initial transaction.

§10 Exclusion of the right of withdrawal for digital content
The right of withdrawal expires prematurely if the customer expressly agrees that the performance of the contract will begin before the expiry of the withdrawal period (e.g., by immediate access to the online course) and confirms that he is aware that he loses his right of withdrawal by giving this consent.

§11 Final Provisions
The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes is Darmstadt, to the extent legally permissible. Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
